By accessing or using Jewelry Vault ("the Service," "the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Sparke Data Solutions ("we," "our," or "us") reserves the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify you of material changes via email or in-app notification.

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your password secure and confidential.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately of any unauthorized use of your account.

You may not share your account credentials, transfer your account to another person, or create multiple accounts without our permission.

When you create shareable links to your Jewelry Box or Wishlist, you make that content publicly accessible to anyone with the link. You are responsible for:

• Deciding what information to include in shared profiles
• Managing who has access to your shareable links
• Understanding that shared content may be viewed, copied, or shared by others
• Revoking or deactivating shareable links when you no longer wish to share

We are not responsible for how others use or misuse information you choose to share publicly.

The wishlist notification feature allows you to invite others to receive updates about your wishlist. By using this feature, you agree to:

• Only send notification invitations to individuals who have given you permission to contact them
• Not use the notification system for spam, harassment, or unsolicited communications
• Respect recipients' right to unsubscribe from notifications at any time
• Provide accurate information about special dates and occasions

Recipients who consent to notifications may unsubscribe at any time using the link provided in notification emails. We reserve the right to disable the notification feature for users who abuse it.

Jewelry Vault's appraisal feature provides estimates for informational and educational purposes only.

• Appraisal estimates are generated using AI and market data, not by certified appraisers.
• Estimates may not reflect actual market value, insurance value, or resale value.
• We do not guarantee the accuracy, completeness, or reliability of any appraisal estimate.
• Estimates should not be used for insurance claims, legal proceedings, tax purposes, or financial transactions.
• We strongly recommend obtaining a professional appraisal from a certified gemologist or jewelry appraiser for official valuations.
• We are not liable for any losses, damages, or decisions made based on our appraisal estimates.

All content, features, and functionality of Jewelry Vault (including but not limited to text, graphics, logos, software, designs, and AI models) are owned by Sparke Data Solutions or its licensors and are protected by copyright, trademark, patent, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission. You may not reverse-engineer or attempt to extract source code from the Service.

Jewelry Vault may offer certain features or services for a fee. If you purchase a paid subscription or service:

• You agree to pay all applicable fees and taxes.
• Fees are non-refundable unless otherwise stated or required by law.
• We may change pricing with advance notice.
• Subscriptions automatically renew unless you cancel before the renewal date.
• We reserve the right to suspend or terminate service for non-payment.

To the fullest extent permitted by law:

• Jewelry Vault is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
• We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or harmful components.
• We are not liable for any direct, indirect, incidental, consequential, punitive, or special damages arising from your use of or inability to use the Service, including but not limited to: data loss, theft or damage to jewelry, inaccurate appraisals, unauthorized access to your account, or reliance on information provided by the Service.
• Our total liability to you for any claims arising from these Terms or your use of Jewelry Vault shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 if you have not made any payments.
• In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability is limited to the maximum extent permitted by law.

We reserve the right to suspend or terminate your access to Jewelry Vault at any time, with or without cause or notice, including but not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended period of inactivity
• Technical or security reasons

You may terminate your account at any time by contacting us at jack@sdsau.ai or using the account deletion feature in the app. Upon termination, your right to use the Service will immediately cease, and we may delete your data in accordance with our data retention policies.

If you have a dispute with us, please first contact us at jack@sdsau.ai to attempt to resolve it informally. If we cannot resolve the dispute informally, any legal action must be brought in the appropriate courts of the jurisdiction in which Sparke Data Solutions operates.

You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration, to the extent permitted by law.
